Zamansky LLC Investigates UBS Financial Advisor Andrew Burish and The Burish Group

According to recent public reports, Burish promoted short-selling shares of the electric car company Tesla, Inc. (TSLA), which allegedly caused losses of more than $23 million for an extended family of investors. These investors recently filed an arbitration claim with the Financial Industry Regulatory Authority, alleging unsuitability, breach of fiduciary duty and failure to supervise. They reportedly claim that Burish failed to provide a “balanced view of the risk of loss” of shorting Tesla.
Under FINRA Rules, all investors are entitled to a balanced presentation of any investment recommendation made to them, according to investment fraud attorney Jake Zamansky. This requires that stockbrokers and financial advisors disclose to their clients the downside risk in full before they invest, Zamansky says, especially when short-selling which is a risky strategy.
